Terms of Service

1. Acceptance of terms

These Terms govern your use of the LectraScan AI mobile app and website (the "Service"), operated by Cien Rios LLC ("Cien Rios", "we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

LectraScan is an educational and informational tool. It transcribes handwritten or printed pages using optical character recognition (OCR), produces an AI-assisted "clarity" rewrite of the transcription, can machine-translate the result into other languages, and lets you organize and export the output. LectraScan does not grade, score, or evaluate student work and does not replace your professional judgment.

3. Eligibility and accounts

• You must be at least 18 years old and using the Service in an educational or professional capacity.
• You are responsible for keeping your credentials secure and for all activity on your account.
• You must provide accurate account information and keep it current.
• Institution accounts are governed additionally by the applicable institution agreement.

4. AI output — no guarantee of accuracy

• OCR, AI clarity rewrites, and translations are generated automatically. They can be incomplete, inaccurate, mistranslated, or misread — including names, numbers, dates, and meaning.
• Outputs are provided for educational and informational purposes only. They are not certified, sworn, legal, medical, financial, or official translations or transcriptions, and are not a substitute for a qualified human translator or professional advice.
• You must review every output against the original document before relying on it for any decision, including grading, feedback, academic integrity, or any communication with students, parents, or institutions.
• Uncertainty markers and confidence indicators are aids, not assurances; the absence of a marker does not mean the text is correct.

5. Acceptable use and your responsibilities

You agree to:

• Upload only documents you are authorized to process, and comply with your institution's policies and applicable data-protection laws (for example FERPA, GDPR, or local equivalents) when documents contain personal data of students or others.
• Not upload unlawful, infringing, or harmful content, or content you do not have the right to use.
• Not attempt to circumvent quotas, security controls, or rate limits, reverse-engineer the Service, or use it to build a competing dataset or product.
• Not share exports or share links containing personal data with anyone who is not entitled to receive them.

6. Your content and intellectual property

• You retain ownership of the documents you upload and the outputs generated from them.
• You grant Cien Rios a limited license to store, process, and transmit your content solely to provide the Service to you, including sending text to the third-party providers listed on our sub-processor page.
• The Service, its software, design, and trademarks belong to Cien Rios and its licensors.

7. Plans, subscriptions, and payments

• Free plan. Includes a limited number of scans and exports per month, as described in the app and on our pricing page.
• Paid plans. Pro and Pro Plus are available today as monthly or annual auto-renewing subscriptions purchased on this website, billed by Stripe. When the mobile apps launch we will also offer them through the App Store and Google Play (planned product identifiers: pro_monthly, pro_annual, pro_plus_monthly, pro_plus_annual); those store subscriptions are not yet available. Prices, currency, and the exact subscription length are shown before you confirm, and in the mobile apps are set by Apple or Google for your region.
• Auto-renewal. Subscriptions renew automatically at the same price for the same period unless you cancel at least 24 hours before the end of the current period. Payment is charged to your App Store or Google Play account at confirmation of purchase and at each renewal.
• Cancelling. Manage or cancel in your Apple subscriptions or Google Play subscriptions settings. Deleting the app or your account does not cancel a store subscription.
• Refunds. Purchases made through the App Store or Google Play are billed and refunded by Apple or Google under their policies; Cien Rios cannot issue refunds for those purchases. Web subscriptions purchased through Stripe can be cancelled from the billing portal on your account page; refunds for web purchases are handled by Cien Rios case by case.
• Restore purchases. Use "Restore previous purchases" in the app to reactivate an existing store subscription on a new device. A subscription unlocks the same plan wherever you sign in.
• Fair use. "Unlimited" features are subject to reasonable use; we may throttle automated or abusive usage.
• Changes. We may change plan features or prices with notice; changes take effect at the next renewal, and you may cancel before then.

8. Data, export, and deletion

You can export your data from the app or your account page at any time, and permanently delete your account and all data it owns from Settings → Privacy → Delete my account, from your account page, or by following lectrascan.cienrios.com/delete-account. See the Privacy Policy for what is retained.

9. Disclaimer of warranties

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OCR, CLARITY, OR TRANSLATION OUTPUT WILL BE ACCURATE, COMPLETE, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIEN RIOS AND ITS SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE — INCLUDING ERRORS IN AI OUTPUT, MISREAD OR MISTRANSLATED DOCUMENTS, OR ACADEMIC, EMPLOYMENT, OR OTHER DECISIONS MADE IN RELIANCE ON OUTPUT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Indemnification

You agree to indemnify Cien Rios against claims arising from content you upload, your breach of these Terms, or your violation of any law or third-party right, including data-protection obligations toward students.

12. Suspension and termination

We may suspend or terminate accounts that violate these Terms, abuse the Service, or create legal risk. You may stop using the Service and delete your account at any time. Sections 4, 6, 9, 10, and 11 survive termination.

13. Changes to these Terms

We may update these Terms. Material changes are announced in the app or by email before they take effect; continued use after the effective date constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Nothing in these Terms limits consumer rights that cannot be waived under the law of your country of residence.

15. In-app AI notice

AI may make mistakes. OCR, clarity, and translation output can contain errors or misinterpretations and is not a certified translation. Review every result against the original before use; LectraScan assists readability and does not replace your judgment.
